Foreword
Minister Naco, like many other ministers of this cabinet, didn’t escape from his commitment in the election campaign, which also means leaving behind state duty. However, numerically speaking, his commitments have been much more moderated than some of his colleagues.
Media has monitored two appointments of Minister Naco in Kucove on the 8th and 16th of June, respectively on a Monday and on a Tuesday. In the first case, the Minister presented the candidates for Municipal Council, but the second case was unprecedented and has been notified at the ZaLart platform. The Minister was attending a youngster wrestling fight, while the activity was held under flags of the political party he represents, also underage girls wearing small t-shirts with the respective logo of the party. We think that it would be more respectful if the Minister would care more about every public appearance, even during the election campaign.
Finalization of justice system analysis
The most important event during this month related to the Ministry of Justice has been the presentation of the document “Analysis of the justice system in Albania – 2015”, on the 8th of June 2015, at the Congress Palace in Tirana, with the participation of 200 invitees. With this public appereance the Special Parlamentary Commision for Justice Reform and High Level Experts Group concluded the first phase of the implementation of the Justice Reform. The Analytic Document of the Justice System is an overall description of how it is organized and functions as well as results given by the system since 1998.
The whole process has received many comments, some of them surprising from highly ranked officials, domestic and foreign. EU’s Delegtion Chief, ambassador Romana Vlahutin, appreciated the commitment and the tenacity of the Special Reform Comission, also expressed gratitude for the experts, which according to her, have been working well to find the right solutions keeping in mind EU standarts. Meanwhile, ambassador Lu, textually said: “ There can be justice reform even without the opposition, but the reform would be better, if it was full and inclusive. US support this process. Corrupted judges should know that change is coming “. But, president Nishani doesn’t share the same opinion. He has toughly criticized the majority of the government for a onesided reform, without the opposition involvement and without concrete results.
We think this first phase of the reform was more than necessary, with experts in the field involved, but the work pace could have been more efficient, especially when PM Rama has promised fulfilling the five EU criterias within September 2015.
A big concession in the horizon
The procedure was opened on the 19th of June and the biddings will be available until the 20th of July. It is a big concession, with a timeline of 20 years and millions of euros invested in services. The concession aims to denationalize for 20 years the state execution service.
Shqiptarja.com portal clarifies that the concession of this service will have as a purpose only the execution of criminal decisions with a fine, procedurial costs decision during all phases of the criminal lawsuit and the civil obligation that often the court establishes in a criminal decision. However, the reason of this concession is unclear, since in Albania in addition to state execution services there are many other private execution companies, to which the interested parties can refer to. Surely the expectation of the passage of this service in the privat sector is to give another work level and increase the service outcome. At the same time, unclear remains the practical way of action of the service and the prices for each execution that the winning company of the concession will establish. All these details are left to be clearified on the contract between the Ministry of Justice and the winning company of the concession, still it seems too late for justice system experts to express their contestation and opinions on the matter.
